This policy explains how Seeksail handles personal information when you use our websites, request yacht-charter advice, communicate with us or progress toward a booking.

Who controls your information
Seeksail, Inc. is the controller of personal information described in this policy unless a disclosed charter operator or other provider acts as a separate controller for its own service. Where this policy applies
This policy applies to guide.seeksail.com, seeksail.com, charter enquiries, adviser communications, bookings and related support. A charter operator, payment provider, insurer, transfer provider, affiliate partner or other third party may provide its own notice and independently decide how it processes information for its service. Their notice also applies when you use that service.
Information we collect
We may collect identity and contact details; country of residence; preferred contact method and time; destination, dates, duration and flexibility; group size and cabin needs; yacht, crew, budget, experience, licence and equipment preferences; accessibility or other requirements you choose to disclose; enquiry and correspondence history; quotation, contract, booking, traveller and payment-status information; marketing preferences; form-consent records; chat messages; and technical data such as IP address, device, browser, pages viewed, referral source, identifiers and interaction data. Payment-card details entered on a hosted payment page are handled by the payment provider rather than stored by Seeksail.
How we use information
We use information to answer enquiries; assess group, route, yacht and crew suitability; check availability with Booking Manager and charter operators; prepare and explain recommendations and quotations; facilitate operator confirmation and contracts; collect and remit payments; arrange support; maintain booking, accounting, fraud-prevention and legal records; secure and improve the websites; measure content and advertising performance; manage consent; and send marketing only where permitted. We do not use the Framer site to promise automated live comparisons or instant shortlists: a Seeksail adviser reviews requests and recommendations.
Legal bases
Where European, UK or Swiss data-protection law applies, we rely on steps requested before entering a contract, performance of a contract, legal obligations, legitimate interests such as responding to enquiries, operating and securing the business, preventing fraud and improving services, and consent for optional analytics, advertising or direct marketing where consent is required. You may withdraw consent at any time without affecting earlier lawful processing. We assess and balance legitimate interests against your rights and expectations.
Enquiries, CRM, communications and human review
Framer sends submitted enquiry information automatically to Brevo so Seeksail can manage the request and customer relationship. Microsoft 365 supports email communications. A Seeksail adviser reviews the information and remains responsible for recommendations, availability checks and customer communications. If internal automation or AI tools are introduced to process personal information, this policy and the relevant safeguards will be updated before that use begins.
Service providers and recipients
We use providers including Framer for hosting, forms, consent tools and site functions; Microsoft 365 for business email; Brevo for CRM, communications, tracking and the current chat service; Google Analytics and Google Tag Manager for consent-controlled measurement and tag management; Google Ads and, while enabled, Pinterest for consent-controlled conversion measurement or advertising; Booking Manager for yacht inventory, search and booking support; Stripe for card payments and hosted payment links; Wise and banks for transfers; and professional advisers and security providers. We disclose only information reasonably needed to charter operators, yacht owners or managers, skippers or crew, payment and insurance providers, transfer providers, authorities and advisers. Those parties may act as processors or as independent controllers depending on their role.
International transfers
Seeksail is based in the United States, its adviser may work from Malaysia, and providers, charter operators and recipients may process information in the United States, Europe, the United Kingdom, Switzerland, Asia or the charter destination. Where applicable law requires a transfer safeguard, we use an adequacy decision, approved contractual clauses or another lawful mechanism, and supplementary safeguards where appropriate. Provider terms commonly include data-processing and transfer provisions, but Seeksail must maintain and periodically review its vendor register and accepted agreements.
How long we keep information
Inactive enquiry and CRM records are normally kept for up to three years after the last meaningful interaction. Booking, payment, accounting, tax, chargeback, fraud and dispute records may be kept for up to seven years after the transaction or relationship ends, and longer only where law, an unresolved claim or a preservation duty requires it. Marketing records are kept until you unsubscribe or withdraw consent, with a limited suppression record retained to respect that choice. Chat histories are normally kept for up to two years after the last interaction. Technical records, consent logs and backups follow documented business needs and provider deletion cycles. Records are reviewed for deletion or anonymisation rather than kept indefinitely by default.
Cookies, analytics, advertising and US disclosures
Essential technologies support security, consent choices, forms and website operation. Optional analytics, advertising and communication technologies should run only after the required choice. Seeksail does not sell personal information for money. When optional advertising tags are enabled, online identifiers and browsing or interaction data may be disclosed to advertising partners for conversion measurement, audience creation or personalised advertising; some US laws may call this targeted advertising, sharing or a sale even when no money changes hands. You can reject optional technologies through the consent banner and contact us to opt out or request access, correction or deletion. We will not discriminate against you for exercising an applicable privacy right.
Your privacy rights by location
Depending on where you live and which law applies, you may ask to access, correct, delete, restrict or object to processing, receive a portable copy, withdraw consent, opt out of marketing or targeted advertising, or appeal a denied request. EEA and UK residents may complain to their local supervisory authority; Swiss residents may contact the Federal Data Protection and Information Commissioner. California residents may use an authorised agent where permitted. We may need to verify identity and may retain information where an exception or legal duty applies. Where California or another US privacy law treats advertising disclosures as a sale, sharing or targeted advertising, Seeksail will provide and honour the applicable opt-out right and will not discriminate against you for exercising it.
Security, children and changes
We use reasonable administrative, technical and organisational safeguards appropriate to the information and service. No internet transmission or storage system is completely secure. Do not send full payment-card details, passport copies or other sensitive documents unless a Seeksail adviser confirms a necessary and appropriate channel. Our services are intended for adults arranging travel; we do not knowingly solicit personal information directly from children. Traveller information about minors should be provided only by a parent, guardian or authorised group organiser when needed for a booking. We may update this policy when services, providers or laws change and will revise the date above.
