These terms explain Seeksail’s role as a yacht-charter booking agent, how website information should be used and how a yacht-charter booking is governed.

About Seeksail
Seeksail, Inc. is a Delaware corporation operating as a travel agency and yacht-charter booking agent. It holds Delaware business licence number 2023700209 for the business activity Travel Agency, valid from January 1 through December 31, 2026. Delaware business licences are renewed by calendar year; Seeksail must renew and update this information for later periods. This licence does not represent that Seeksail holds every registration another jurisdiction may require. Seeksail helps customers identify suitable yachts, communicates with charter operators and facilitates quotations, documentation, payment and support. It does not own, manage or operate charter yachts unless a booking document expressly states otherwise.
Who may book
You must be at least 18 years old and have authority to book on behalf of everyone in your group. You are responsible for passing these terms, the operator’s terms and the booking information to the other travellers. You must give Seeksail accurate residence and contact details and tell us if they change before you pay. Seeksail may refuse a booking where it cannot lawfully or responsibly provide the requested service.
Using the websites
You may use this website only for lawful personal or business travel enquiries. Information you provide must be accurate, current and authorised, including information about other travellers. Do not misuse the site, interfere with security, submit unlawful material, impersonate another person, or attempt to scrape, copy or reverse-engineer the service. Website content is general information and is not a binding offer.
Advice, search results and availability
Seeksail advisers review requests and help identify yachts that may suit the stated destination, dates, group, experience, budget and priorities. Search results, editorial guides, indicative costs and adviser shortlists do not guarantee availability, condition, equipment, layout, operator acceptance or final price. Availability and booking terms must be confirmed by the relevant operator. Customers remain responsible for reviewing the specific yacht specification, quotation and contract before paying.
Your charter contract and Seeksail’s role
Except where the written booking documents expressly state otherwise, the charter contract is between you and the disclosed charter operator—the yacht owner, manager or charter company named in the quotation and charter contract—and Seeksail acts only as the operator’s booking and payment-collection agent. A yacht charter booked through Seeksail is a single travel service supplied under the operator’s own charter terms. Those terms govern the yacht service, check-in, technical condition, safety decisions, substitutions, crew supplied by the operator, security deposits, damage handling, cancellations and changes. You must read and accept the applicable operator terms before paying. Seeksail is not a party to the operator’s performance obligations merely because it facilitates the booking or collects payment as agent. If these terms conflict with the signed charter contract on a booking-specific matter, the charter contract controls that matter, subject to mandatory law and the agency obligations Seeksail has expressly assumed.
Prices, extras and payments
Displayed or quoted yacht prices may exclude obligatory extras, local taxes, deposits, damage waivers, crew, provisioning, fuel, marina or mooring fees, transfers and optional equipment. The operator quotation and charter contract are definitive. Taxes imposed on the charter service at the destination, including applicable VAT, sales, charter or local taxes, are normally calculated, collected and remitted by the yacht operator as stated in its quotation or contract; Seeksail remains responsible for taxes on its own agency income. Unless the quotation states otherwise, a deposit—usually 50% of the charter price—is due to confirm the booking and the balance is due by the date stated in the quotation or operator’s terms. Seeksail collects payments as the operator’s agent through a Stripe-hosted payment page, Wise or bank transfer and remits them to the operator promptly, normally within five business days of receipt, retaining only the commission agreed with the operator. That commission is included in the operator’s price and does not increase it. Payment received by Seeksail as the operator’s agent discharges your payment obligation to the operator to that extent. Once remitted, funds are held by the operator under its terms, including its cancellation terms. Seeksail does not hold client funds in trust and does not provide package-travel insolvency protection; where the law of the operator’s country requires the operator to hold a guarantee or insurance, that protection applies under the operator’s terms. Seeksail charges no booking fee unless the quotation says so. Prices are payable in the stated currency; conversion and bank charges applied by your bank, card issuer or transfer provider are for your account. Verify every payment instruction through an established Seeksail channel before paying; Seeksail never changes bank details by email alone.
No cooling-off period
A yacht charter is a leisure service supplied for a specific date or period. Once a booking is confirmed, a statutory withdrawal or cooling-off right generally does not apply, including under the usual European Union and United Kingdom exceptions for dated leisure services. Cancellation is governed by the operator’s terms, the quotation and any mandatory law that applies to the booking.
Licences, experience and crew
The customer must ensure that the nominated skipper and crew have the licences, radio certificates, experience, visas, travel documents and competence required by the operator and authorities. Operator acceptance of qualifications is final. On many bareboat charters, a professional skipper is engaged directly by the customer as an independent contractor and is not an employee or contractual representative of Seeksail or the yacht operator. Where that arrangement applies, the customer and skipper are responsible for their separate agreement, remuneration, food, cabin and onboard arrangements. Seeksail may pass on a skipper’s contact details as a courtesy but does not vet, employ, supervise or pay the skipper and does not collect the skipper’s fee. In other bookings the operator may supply or contract the skipper or crew, in which case the operator’s documents control. The written booking documents and the actual relationship prevail over any general description. Advice from Seeksail does not replace official or operator confirmation.
Cancellations, changes, yacht problems and complaints
Cancellation, amendment, late arrival, no-show, force-majeure, substitution, breakdown and refund rights are governed primarily by the operator contract and mandatory law. Where the operator’s terms make a deposit or payment non-refundable, Seeksail cannot refund it. Refund amounts are determined by the operator under its terms and are paid through Seeksail or by the operator directly, without deduction other than applicable bank or payment-provider charges. Contact both Seeksail and the operator promptly about a problem and allow the responsible supplier a reasonable opportunity to remedy it. Seeksail will assist with communications and records but cannot promise an outcome controlled by the operator, insurer, bank or payment provider. Chargebacks do not replace the contractual claims process and may delay resolution.
Transfers, insurance, provisioning and affiliate services
Seeksail currently intends to arrange yacht charters as standalone travel services. Separately offered transfers, accommodation, insurance, provisioning and other services are governed by the relevant provider’s contract. An operator may offer an airport transfer or another add-on, usually as a separately priced service and sometimes payable at the base. Where the operator asks Seeksail to pass on that payment, Seeksail does so as the operator’s agent and does not operate the transfer or retain a commission on it. Seeksail may also provide clearly labelled links to independent providers for provisioning, transfers, hotels or travel insurance. A purchase completed on that provider’s website is a separate contract with that provider under its terms and privacy notice; Seeksail may receive an affiliate commission where disclosed. Mandatory package-travel or linked-travel-arrangement rules apply whenever the circumstances of a transaction legally meet their requirements.
Enquiries and communications
Submitting an enquiry, opening a Booking Manager result or receiving a shortlist does not create a charter contract or reserve a yacht. A booking becomes binding only when the required parties accept it under the quotation or contract and the required payment is received. You agree that Seeksail may communicate with you electronically by email, telephone, messaging services or the current website chat and that electronic acceptance of a quotation and the operator’s terms is binding to the extent permitted by applicable law. Keep copies of the final quotation, operator contract, payment confirmation and important communications.
Intellectual property
The website design, original copy, Seeksail marks and other Seeksail materials are protected by intellectual-property law. You may view and print reasonable extracts for personal trip planning, but may not republish, sell, systematically copy or create a competing database from them without permission. Manufacturer, operator and third-party names, images, specifications and marks remain the property of their respective owners and are used for identification or with permission.
Responsibility and liability
Seeksail will provide its own agency, advisory, payment-handling and support services with reasonable care and skill. To the fullest extent permitted by law, Seeksail is not responsible for the acts, omissions, insolvency or service failures of an independent operator, independently engaged skipper or other supplier; weather, sea state, route, port or authority decisions; customer-provided inaccuracies; or losses outside Seeksail’s reasonable control. Claims concerning the yacht service must normally be made against the contracting operator under its charter terms, and claims concerning a directly engaged skipper under the customer’s agreement with that skipper. Seeksail is not liable for indirect or consequential loss, loss of enjoyment or loss of profit. To the fullest extent permitted by law, Seeksail’s total liability to you in connection with a booking is limited to the commission Seeksail retained on that booking. This allocation does not exclude or limit Seeksail’s responsibility for its own fraud, wilful misconduct, negligent performance of an expressly assumed duty, mishandling of funds it holds, death or personal injury caused by its negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer and package-travel rights remain unaffected.
Language and general terms
The English version of these terms is the current reference version. If Seeksail later publishes a complete version in a different language, the version required by mandatory law for a particular customer or transaction will apply. The version in force when you book applies to that booking; Seeksail may update these terms for future bookings and will revise the date above. These terms, the quotation and the operator’s charter contract form the agreement relevant to a booking. If any provision is held invalid, the remainder continues to apply. Seeksail may assign its rights and obligations to a successor of its business; you may not assign a booking without the operator’s consent. A failure to enforce a provision is not a waiver. Nothing in these terms waives a right that cannot lawfully be waived.
Governing law and contact
These terms and Seeksail’s services are governed by the law of the State of Delaware, United States, without removing mandatory consumer-protection, package-travel, privacy or jurisdictional rights that apply where you live. Please raise any dispute with Seeksail first at contact@seeksail.com; Seeksail aims to respond within 14 days. Subject to a consumer’s mandatory right to bring or defend proceedings in the courts of their place of residence, the state and federal courts located in Delaware have jurisdiction over disputes between you and Seeksail. Seeksail offers and completes services only where it may lawfully do so and may decline or discontinue an enquiry or transaction where a required registration, licence or other condition is not satisfied.
